1. Introduction

Welcome to Groupnavv ("the App"). These Terms and Conditions ("Terms") govern your use of the App, related services, and any associated websites. The App is provided and operated by its independent developer ("we," "us," or "our"). By downloading, installing, or using the App, you agree to these Terms. If you do not agree, you must not use the App.

2. Eligibility

• You must be at least 13 years old to use the App.
• If you are under 18, you must have a parent or guardian's consent.
• By using the App, you represent that you have the legal capacity to enter into this agreement.

3. App Features

Groupnavv provides:

• Real-time location sharing among group members.
• Navigation and route creation with waypoints.
• Group chat and event planning.
• Subscription tiers (Free, Premium, VIP) with different feature access.

We may add, remove, or modify features at any time without prior notice.

4. User Accounts

• You must create an account to use most features.
• You are responsible for maintaining the confidentiality of your login details.
• You agree not to share your account or impersonate others.
• We reserve the right to suspend or terminate accounts for violations of these Terms.

5. Subscriptions & Payments

• Subscription plans (Free, Premium, VIP) are billed via Google Play (and Apple App Store when available).
• All fees are displayed in your local currency and include applicable taxes.
• Subscriptions auto-renew unless cancelled before the renewal date.
• Refunds are handled according to Google Play's or Apple's refund policies and the Australian Consumer Law.
• We may adjust subscription prices with reasonable notice.

6. User Obligations

You agree not to:

• Use the App while operating a vehicle in a way that distracts from safe driving.
• Share false, misleading, or harmful information.
• Upload offensive, illegal, or infringing content.
• Attempt to reverse-engineer, hack, or misuse the App.

7. Safety Disclaimer

• The App is intended as an assistance tool only.
• We do not guarantee the accuracy of maps, routes, or ETAs.
• You are solely responsible for your driving decisions, compliance with road laws, and safety.
• We are not liable for accidents, damages, or losses resulting from your use of the App.

8. Location Data & Privacy

• The App collects and shares your real-time location with your chosen groups.
• By using the App, you consent to this data being processed and displayed to group members.
• We will never sell your personal or location data to third parties.
• Our Privacy Policy explains how your information is collected, used, and stored.

9. Content & Community Rules

• You may post text, images, and other content in chats or events.
• You retain ownership of your content but grant us a non-exclusive license to display and distribute it within the App.
• We reserve the right to remove content that violates these Terms or is illegal, abusive, or harmful.

10. Intellectual Property

• All intellectual property in the App (software, branding, design, content) belongs to us or our licensors.
• You may not copy, modify, or distribute any part of the App without prior written consent.

11. Termination

We may suspend or terminate your account immediately if:

• You breach these Terms.
• Your use of the App risks harm to us, other users, or third parties.

You may delete your account at any time via settings. Subscription cancellations remain governed by platform policies.

12. Limitation of Liability

To the fullest extent permitted by law:

• We exclude all warranties, express or implied, about the App.
• We are not liable for indirect, incidental, or consequential damages.
• Our total liability is limited to the amount you paid (if any) in the last 12 months.
• This does not exclude your rights under Australian Consumer Law, which cannot be waived.

13. Indemnity

You agree to indemnify and hold us harmless from any claims, damages, or costs arising from your use of the App or violation of these Terms.

14. Changes to Terms

We may update these Terms from time to time. If changes are material, we will provide notice via the App or email (if available). Continued use of the App means you accept the updated Terms.

15. Governing Law

These Terms are governed by the laws of Western Australia and the Australian Consumer Law. Any disputes will be subject to the exclusive jurisdiction of the courts of Western Australia.
